Introduction

Welcome to USAMDR Tours & Travel (“USAMDR,” “we,” “our” or “the Company”).

These Terms and Conditions govern the use of our website, the purchase of our travel services and the relationship between USAMDR Tours & Travel and our clients (“Client,” “you” or “traveler”).

By using our website, requesting a quote, making a booking or purchasing any of our services, you acknowledge that you have read, understood and accepted these Terms and Conditions.

1. Company information

Trade name: USAMDR Tours & Travel

USAMDR Tours & Travel is a registered company with its main operations in Louisville, Kentucky. The Company will comply with the applicable laws and regulations of the State of Kentucky and the U.S. federal laws that apply to its services.

Where applicable, any license, registration, authorization, permit or information required by applicable law will be indicated on the website, contracts, invoices and/or booking documents.

2. Our services

USAMDR Tours & Travel offers planning, coordination and organization services for personalized travel experiences.

Depending on the package purchased, our services may include:

  • Personalized trip planning.
  • Tours and excursions.
  • Accommodation in hotels and resorts.
  • Ground transportation.
  • Driver services.
  • Tour guides.
  • Activities and experiences.
  • Flight tickets or bookings.
  • Cruises.
  • Airport-hotel transfers.
  • Culinary and cultural experiences.
  • Personalized itineraries.
  • Assistance and guidance during the trip.
  • Other travel-related services.

The services included in each trip are those expressly stated in the corresponding quote, proposal, invoice, booking confirmation or contract.

USAMDR may act as a planner, coordinator, intermediary or booking agent, depending on the nature of the service purchased. Where applicable, services will be provided directly by independent providers.

3. Personalized experiences

One of the goals of USAMDR Tours & Travel is to offer trips tailored to each client's needs, interests, budget and dates.

For this reason, not all trips will have the same services, prices, activities or conditions.

Each proposal may include:

  • Travel dates.
  • Number of travelers.
  • Destinations.
  • Hotels.
  • Transportation.
  • Activities.
  • Excursions.
  • Additional services.
  • Total price.
  • Required deposit.
  • Payment dates.
  • Specific cancellation policies.

The client must carefully review the proposal before approving it. Approving a proposal means accepting the services, prices and conditions stated in it, together with these Terms and Conditions.

4. Quotes and prices

Quotes provided by USAMDR Tours & Travel are subject to availability and to the conditions of the corresponding providers.

Prices for flights, hotels, cruises, vehicles, excursions and other services may change until the booking has been confirmed and/or paid.

A quote is not necessarily a confirmed booking.

Once the client approves a proposal, the client must make the required payment or deposit within the stated period to secure the services, where applicable.

Taxes, fees, charges, baggage fees, seat selection fees, resort fees or other charges may be included or excluded, as expressly stated in the quote.

USAMDR will strive to present clear and accurate prices. However, if an obvious error in price, availability or description is detected before final confirmation, USAMDR may correct it and offer the client the option to accept the corrected price or cancel the related request.

5. Bookings and confirmation

A booking will be considered confirmed only when:

  • The client has accepted the corresponding proposal;
  • The required deposit or payment has been received; and
  • USAMDR Tours & Travel has confirmed the availability and booking of the services.

Receiving a request or a payment does not by itself guarantee the availability of a service until it has been confirmed.

The client will receive, where applicable, confirmation documents with the details of the trip.

Confirmation of a booking may be subject to the additional conditions of the airline, hotel, cruise line, tour operator, transportation company or other corresponding provider.

6. Payments

Payment conditions will be stated before the booking is confirmed.

Depending on the service purchased, the following may be required:

  • Initial deposit;
  • Partial payments;
  • Full payment;
  • Final payment before a specific date.

Failure to meet a payment date may result in the cancellation of a booking, loss of availability, changes in price or the application of penalties set by the provider.

USAMDR Tours & Travel may set different payment conditions for different packages or services.

Unless expressly stated otherwise, payments made by the client will be applied first to overdue charges, fees, penalties or balances, and then to the cost of the services purchased.

7. Payment methods

USAMDR Tours & Travel may accept the payment methods indicated at the time of booking.

Payments must be made only through the official methods provided by USAMDR Tours & Travel.

The client must not give financial information to persons who are not authorized by the Company.

The client authorizes USAMDR, where applicable, to process the payments necessary for the approved services, always in accordance with the corresponding quote, invoice or authorization.

8. Cancellations requested by the client

Cancellation conditions will depend on the service purchased.

Some services may be:

  • Refundable;
  • Partially refundable;
  • Non-refundable;
  • Subject to cancellation charges;
  • Subject to the provider's specific policies.

Before a booking is made, USAMDR Tours & Travel will inform the client, where possible, of the applicable cancellation conditions.

When a provider charges a penalty or withholds an amount of money because of the client's cancellation, USAMDR may pass that penalty on to the client, in accordance with the conditions previously communicated.

Planning, service or management fees that have been identified as non-refundable will not be returned, where applicable.

Cancellation requests must be made in writing through USAMDR's official email. The date and time the request is received may be used to determine the applicable penalties.

9. Refunds

Refunds will be subject to the conditions of the service purchased and of the corresponding provider.

USAMDR Tours & Travel cannot guarantee a refund when the provider does not allow it, except where an applicable law establishes a different right.

When USAMDR Tours & Travel is responsible for processing a refund that is legally due, it will be handled in accordance with applicable laws and the provider's procedures.

For certain flights to, from or within the United States, refund rights established by the U.S. Department of Transportation may exist in certain circumstances, including cancellations or significant changes.

The specific conditions of each airline ticket must be reviewed before purchase.

Unless applicable law requires a different period, approved refunds will be processed within a reasonable time after USAMDR receives the corresponding funds from the provider, when the refund depends on that provider.

Refunds will be made, where possible, using the same payment method used for the original purchase.

10. Changes requested by the client

After a booking is confirmed, any change requested by the client may be subject to:

  • Availability;
  • Price difference;
  • Provider charges;
  • Administrative fees;
  • Cancellation penalties;
  • New applicable rates.

USAMDR Tours & Travel will inform the client of known costs before processing a change, when reasonably possible.

A change will not be considered confirmed until the client receives written confirmation from USAMDR or the corresponding provider.

11. Changes or cancellations made by providers

Flights, hotels, cruises, excursions, carriers and other providers may modify schedules, itineraries, availability or conditions.

USAMDR Tours & Travel will inform the client of relevant changes it becomes aware of and will help coordinate alternatives when the service purchased allows it.

However, USAMDR Tours & Travel does not control the operational decisions of airlines, hotels, cruise lines, transportation companies, government authorities or other independent providers.

When a provider cancels or modifies a service, the available options may be limited to the alternatives, credits or refunds offered by that provider.

12. Flights and air transportation

When USAMDR Tours & Travel arranges flights for a client, the air transportation contract may additionally be subject to the airline's conditions.

The client is responsible for verifying that their name, date of birth and other information provided for the booking are correct.

Errors in names or other data provided by the client may result in charges, restrictions or even prevent boarding.

USAMDR Tours & Travel will not be responsible for losses caused by incorrect information provided by the client.

The client is also responsible for verifying departure times, check-in requirements, baggage, documents and other conditions that apply to the ticket.

13. Travel documents

The client is responsible for having the documents needed for their trip.

Depending on the destination, these may include:

  • Valid passport;
  • Visas;
  • Permits;
  • Travel authorizations;
  • Immigration documents;
  • Health requirements;
  • Documentation for minors;
  • Other documents required by authorities.

USAMDR Tours & Travel may provide general guidance on known requirements, but the client must directly verify the official requirements that apply to their personal situation.

The final responsibility for holding valid documentation lies with the traveler.

USAMDR will not be responsible for expenses, losses, delays or cancellations resulting from the lack of valid documents or from an authority's refusal to allow travel or entry to a destination.

14. Entry requirements for the Dominican Republic

Entry requirements for the Dominican Republic may vary depending on the traveler's nationality, country of residence, documentation and circumstances.

The client must verify the corresponding official requirements before traveling.

USAMDR Tours & Travel does not guarantee a traveler's admission to any country.

A decision by immigration, customs, border security or another government authority is outside the control of USAMDR Tours & Travel.

15. Hotels and accommodation

The photographs, descriptions and features of hotels shown on our website, quotes or promotional materials are intended to provide general information.

Rooms, facilities, services, hours and amenities are subject to the hotel's conditions.

Some hotels may charge the client directly for:

  • Deposits;
  • Resort fees;
  • Taxes;
  • Service charges;
  • Damage charges;
  • Additional guest charges;
  • Other charges.

When such charges are not included in the price purchased, they will be the client's responsibility.

Special requests, including room type, beds, location, accessibility, views or additional services, are subject to availability and will not be considered guaranteed unless expressly confirmed in writing.

16. Tours, excursions and activities

Activities may involve certain levels of risk inherent to their nature.

Before taking part in an activity, the client must report any relevant limitation that may affect their participation.

Activities may be subject to weather conditions, age, weight, health or experience requirements, safety rules or other restrictions set by the provider.

USAMDR Tours & Travel may recommend activities, but the client must follow the provider's safety instructions.

The client takes part in activities voluntarily and must assess whether the activity is suitable for their physical, medical and personal condition.

17. Ground transportation and drivers

When the package includes ground transportation, it will be provided by USAMDR Tours & Travel or by an independent provider, as indicated in the booking.

Transportation schedules may be affected by:

  • Traffic;
  • Weather conditions;
  • Accidents;
  • Road closures;
  • Flight delays;
  • Decisions by authorities;
  • Other circumstances beyond the Company's reasonable control.

The client must provide correct information about flights, hotels and schedules to facilitate transportation coordination.

The client must follow the driver's instructions and the safety rules that apply to the vehicle.

18. Traveler safety

USAMDR Tours & Travel seeks to help travelers enjoy well-organized experiences suited to their needs.

However, no destination, activity or trip can guarantee absolute safety.

The client must follow the safety recommendations and instructions of guides, drivers, hotels, operators and local authorities.

USAMDR Tours & Travel cannot guarantee that a destination is free of accidents, crime, illness, natural disasters or other risks.

19. Responsibility of third parties

USAMDR Tours & Travel may work with independent providers, including:

  • Airlines;
  • Hotels;
  • Resorts;
  • Cruise lines;
  • Transportation companies;
  • Guides;
  • Excursion operators;
  • Restaurants;
  • Rental companies;
  • Other travel providers.

These providers are responsible for delivering their own services under their respective conditions.

USAMDR Tours & Travel will act as organizer, intermediary or coordinator, as appropriate to the service purchased.

USAMDR will not be responsible for acts, omissions, delays, cancellations, injuries, losses, damages, itinerary changes, breaches or decisions of independent providers, except to the extent that applicable law provides otherwise.

Nothing in these Terms is intended to exclude rights that the client has under applicable laws and that legally cannot be excluded or limited.

20. Force majeure

USAMDR Tours & Travel will not be responsible for failures or delays caused by circumstances beyond its reasonable control.

These circumstances may include, among others:

  • Hurricanes;
  • Earthquakes;
  • Floods;
  • Storms;
  • Pandemics or health emergencies;
  • Wars;
  • Terrorism;
  • Strikes;
  • Riots;
  • Border closures;
  • Government decisions;
  • Immigration restrictions;
  • Infrastructure failures;
  • Transportation problems;
  • Provider cancellations;
  • Other extraordinary events.

Where possible, USAMDR Tours & Travel will help the client identify available alternatives.

21. Travel insurance

USAMDR Tours & Travel recommends considering the purchase of appropriate travel insurance.

Depending on the policy, insurance may provide coverage for situations such as:

  • Cancellation;
  • Trip interruption;
  • Medical emergencies;
  • Baggage;
  • Delays;
  • Evacuation;
  • Other covered events.

Coverage will depend exclusively on the terms of the policy purchased.

USAMDR Tours & Travel does not guarantee that a claim will be approved by an insurance company.

22. Client responsibility

The client agrees to:

  • Provide true and complete information.
  • Carefully review all travel documents.
  • Meet payment dates.
  • Follow the rules of hotels and providers.
  • Respect the laws of the destination.
  • Follow safety instructions.
  • Keep their travel documents secure.
  • Arrive on time for flights, excursions and transportation.
  • Immediately report any problem related to the services purchased.
  • Inform USAMDR of special needs, medical restrictions or relevant limitations before confirming the booking.

23. Minors

Minors must travel accompanied and have the authorizations and documentation required by applicable laws.

The responsible adult will be responsible for providing correct information and for supervising the minor during the trip.

  • Quotes;
  • Bookings;
  • Payments;
  • Itinerary changes;

Commercial or promotional communications will be subject to the client's preferences and applicable laws.

The client may ask to stop receiving promotional communications by following the instructions included in those communications or by contacting USAMDR.

27. Privacy

USAMDR Tours & Travel will collect and use personal information in accordance with its Privacy Policy.

Information may be used, when necessary to provide the service, to manage bookings with airlines, hotels, tour operators, transportation companies, payment processors and other travel-related providers.

The Privacy Policy will be available in a separate section of the website.

USAMDR will strive to handle personal information reasonably and in accordance with the applicable laws of the State of Kentucky and the United States.

28. Fraud and unauthorized payments

USAMDR Tours & Travel reserves the right to cancel or suspend a booking when there are reasonable signs of:

  • Fraud;
  • Unauthorized use of a card;
  • False information;
  • Identity theft;
  • Illegal activity;
  • Attempts to evade payment conditions.

Where applicable, any refund will be processed in accordance with applicable law and the conditions of the service.

29. Limitation of liability

To the extent permitted by the applicable laws of the State of Kentucky and U.S. federal law, USAMDR Tours & Travel will not be responsible for damages, losses, delays, expenses or inconvenience caused exclusively by acts or omissions of third-party providers or by circumstances beyond the Company's reasonable control.

Nothing in these Terms is intended to limit a liability that cannot legally be limited or excluded, including any liability that cannot be waived under the applicable laws of Kentucky or the United States.

30. Complaints and claims

If the client experiences a problem during their trip, they must contact USAMDR Tours & Travel as soon as possible so that we can try to help resolve the situation.

Claims directly related to a specific provider may also be subject to the procedures established by that provider.

31. Governing law and dispute resolution

These Terms and Conditions will be governed by and interpreted in accordance with the laws of the State of Kentucky, without prejudice to any U.S. federal laws that may apply.

Before starting legal action, the parties will try in good faith to resolve any dispute related to the services purchased through direct communication with USAMDR.

Unless applicable law provides otherwise, any action or proceeding related to these Terms or to USAMDR's services must be brought before a competent court located in Jefferson County, Kentucky, or before the competent federal court.

Nothing in this section is intended to prevent a consumer from exercising rights that cannot be waived under applicable laws.

32. Changes to these terms

USAMDR Tours & Travel may update these Terms and Conditions when necessary to reflect changes in our services, operations or legal requirements.

The version published on the website will be the current version as of the date shown as “Last updated.”

Changes will not retroactively affect the contractual rights that belong to the client under the law.

The invalid or unenforceable provision will be interpreted, where legally possible, so as to come as close as possible to the original intent of the parties.

34. Entire agreement

These Terms and Conditions, together with the quote, booking confirmation, specific contract, cancellation policy, privacy policy and any other expressly incorporated document, constitute the agreement that applies to the services purchased.

When a booking confirmation contains a specific condition that differs from a general condition of these Terms, the specific condition of the booking may prevail with respect to that particular service, provided it is legally valid.
